Summer 2012 Federal Highlights

The CFPB has been extremely busy this summer, issuing the following proposed rules relating to the mortgage business:

  • Integrated Mortgage Disclosures under RESPA and TILA
  • High-Cost Mortgage Amendments under TILA
  • Loan Originator Compensation under TILA and Loan Originator Qualifications
  • TILA Mortgage Servicing Requirements
  • RESPA Mortgage Servicing Requirements
  • Copies of Appraisals under ECOA and Regulation B
  • Appraisal Requirements for Higher-Risk Mortgages under TILA

The CFPB is accepting complaints from consumers against non-bank entities.  Such entities are responsible for creating an account with the CFPB through which consumer complaints can be reviewed and through which responses are sent.  The CFPB imposes strict deadlines for responding to complaints, so make sure your company is on board.  To request access to the portal, email CFPB_FIassistance@cfpb.gov with your company name and the name, phone number, and email address of your company’s point of contact requesting access to the portal. CFPB’s Consumer Response will review your request and follow-up with your company’s point of contact.
