Court Rules in Favor of Mulvaney at CFPB

The U.S. District Court for the District of Columbia denied a preliminary injunction for Leandra English in her attempt to unseat President Trump’s OMB Director Mick Mulvaney as CFPB Acting Director. The standard for granting such an injunction includes the likelihood the plaintiff would win on the merits. The court ruled that standards had not been met. Ms. English could continue to pursue legal action but her case is losing momentum. Furthermore, it is not clear whether the remedy (should English prevail) be reinstatement as Acting Director. It could be something far less, such as loss of back pay and benefits. It seems that Director Mulvaney’s position has become even more secure!
